These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising, pack or promotional materials. Entry and claim instructions are deemed to form part of the Terms and Conditions and by entering this promotion all participants will be deemed to have accepted and be bound by the Terms and Conditions. Participants should retain a copy for their information.

The Promoter takes data protection seriously. By entering in this promotion, participants confirm that they have read the Privacy Policy, and agree to these Terms and Conditions of the promotion. By submitting any information required as part of their participation into the campaign, participants agree to their information being held and processed in accordance with the General Data Protection Regulation (GDPR) and Data Protection Act 2018.

Eligibility

1.    The promotion is open to United Kingdom (England, Scotland, Wales and Northern Ireland), Isle of Man and Channel Island residents aged 18+ only.

2.    This promotion excludes employees and the immediate families of the Promoter, its affiliated companies, agents, or anyone else professionally connected to the promotion.

3.    Internet access via the promotional link and registration of details including first name, last name, county, country, age requirements and a genuine personal email account required for entry. 

4.    Purchase of a promotional pack, containing a unique promotional code and a valid till receipt or copy of online order showing the purchase of a promotional pack within the stated promotion period are necessary. Participants should upload the unique code from the promotional pack as part of the entry process and should retain the promotional pack till receipt/online order as proof of purchase as it will be required for claiming the E-reader and Portable Speaker prizes amongst others.

5.    No purchase necessary postal route for Northern Ireland residents only. See below for details of how to enter without purchase (Northern Ireland residents only). 

6.    There is a maximum of one prize tier item, an E-reader, a Portable Speaker, 6-month Audiobook service subscription and a Magazine subscription E-Gift card prize per person, and a maximum of one prize tier item type per household during the promotional period i.e., no person or household can win more than one of each of the prize types available. There is no limit to the number of times a participant may enter, provided that each such entry is supported by a new and valid till receipt or copy of an online order (i.e., a proof of purchase). Anyone trying to circumvent this rule by using alternative details or proof of purchase from packs not intended for use in this promotion will be disqualified.

7.    Entries (bulk or otherwise) made from trade, consumer groups, agents, third parties or syndicates will not be accepted. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of programme, application, script, brute force, or any other automated means, that person’s entry(ies) will be disqualified, and any prize awarded will be void.

8.    Conduct of entry: The Promoter reserves the right at its sole discretion to disqualify any entrant found to be tampering with this entry process or the operation of the promotion; or to be acting in any manner deemed by the Promoter to be in violation of the Terms and Conditions; or to be acting in any manner deemed by the Promoter to be disruptive.

9.    Anyone trying to circumvent the rules stated in these Terms and Conditions by using alternative details will be disqualified from this promotion.


Promotional Period

10.    The main promotion will open at 00:00 on 30.05.22 and close at 23:59 on 31.08.22.

1,000 Instant win online prizes will be available to be won in this period.

11.    After the main promotion, for any entry received between 00:00 on 01.09.22 and 23:59 on 31.12.22 there will still be an opportunity to win one of 100 x £20 Magazine E-Gift cards in a Late draw. This Late draw will take place on 03.01.23. There will be no online Instant Win element for this part of the promotion thus these entries will only be entered into the Late draw.

12.    The Promoter reserves the right to add any prizes that have not been won from the main promotional period into this late draw.

Entry Requirements

13.    For the chance to win, participants must purchase a pack from the NESCAFÉ GOLD Frothy Coffee range (see list below), subject to availability, whilst stocks last and scan the QR code on-pack or visit https://www.nescafe.com/gb/about-us/perks/win-me-moment/ and log-in or create an account. Participants should retain their receipt/proof of purchase.

14.    Entrants will be required to login or create an account providing their full name, date of birth, county, country, a valid email address (which is personal and accessible throughout the promotion), and confirmation of which retailer the product was purchased from.


15.    To complete the entry process, entrants will need to upload details of their unique code from the pack. They will also need to keep a copy of the till receipt/proof of purchase. 

16.    All valid entrants will then see immediately if, during the promotional period, they are an online winner of an instant prize and they will receive a confirmation email. 

17.    Only valid entry information including codes will be accepted, and the Promoter reserves the right to disqualify and reject any inappropriate entries. All entry information is subject to verification and interrogation. 

18.    Incomplete, illegible, misdirected or entries received outside any promotional period will not be accepted. Proof of sending will not be accepted as proof of delivery. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.

19.    To enter without purchase in Northern Ireland only – qualifying participants must send their name, age, full postal address and email address to: Nescafé Win Your Me-Moment 2022, NPN, Consumer Services, Nestlé UK Ltd, Nestlé House, Haxby Road, York YO91 1XY.  Once the request has been verified, a special randomly numbered code will be provided via email, which can then be entered on the microsite in place of a unique code from purchased pack. Such entries will be required to follow the same process of registration etc., to allow entry into the promotion. Free codes have the same chance to win as receipts/entries from participating packs. Only one entry per stamped, correctly mailed envelope. A maximum of two (2) ‘No Purchase Necessary’ entries permitted per person throughout the promotion period. ‘No Purchase Necessary’ applications must be received by the Promoter no later than 23.59 on 26.08.22, to give sufficient time to be processed before the end of the main promotional period. Applications received after this date but before 20.12.22 will still be able to be enter into the Late draw.

‘No Purchase Necessary’ requests will be subject to verification.

21.    Only promotional flashed stock featuring the “Chance to Win Your Me-Moment, 1,000 Online Instant Win Prizes Available” can be used for entry into this promotion. Flashed stock is subject to availability, while stocks last.

22.    Consumers who select a participating promotional product as part of an online shop, but who receive a substitute product(s) in their order should contact the Nestlé Consumer Services team either by email at: consumer.services@UK.nestle.com or by telephone on Freephone 0800 585759. Providing the user can provide proof of purchase, and proof of substitution, the consumer may still be able to enter the promotion at the discretion of the Promoter.

24.    There are 1,100 prizes available to be won in total. 

25.    A maximum of one (1) prize product type, a E-reader, Portable Speakers, Audiobook service subscription – 6 months, & Magazine subscription £20 E-Gift card can be won in total per person and a maximum of one (1) prize value type, a E-reader, Portable Speakers, Audiobook service subscription – 6 months, & Magazine subscription £20 E-Gift card can be won in total per household throughout the duration of the promotional period. For the avoidance of doubt, so a person and the corresponding household can only win one of all of the different value prize types between them. Neither an individual and their own household can win more than one prize value type.

4.    When you’ve finished shopping, continue to checkout
5.    At the payment page, enter your E-Gift Card code
6.    If your order exceeds the amount of your E-Gift Card, you can pay the remaining balance using any other accepted payment method (credit, debit card or PayPal)
7.    If you don’t spend all of your E-Gift Card, the remaining balance will be available for your next purchase

Prizes are strictly non-transferable and must not be sold, auctioned nor advertised for sale whether on the internet, in newspapers or elsewhere. Any person found in breach of this term will be disqualified from participating. No cash alternatives or other alternative prize will be available in whole or in part, except in the event of circumstances outside the reasonable control of the Promoter, whereby the Promoter reserves the right to substitute the prizes with prizes of equal or greater value. Unless agreed in writing and therefore overriding the above, the prize will only be awarded directly to the winner.

 Winner selection and notification 


27.    Online Instant Winners - During the promotion, online instant win prizes will be randomly allocated and linked to open ‘winning moments’ that have been randomly pre-selected by a secure independently verified computer programme. There are 1,000 winning moments available throughout the promotion. The first person to enter the promotion at the same time as, or be the first after, any allocated winning moment will be deemed to have won. All 1,000 prizes are available to be won but may not be won if not all the winning moments are matched.

28.    The winning moments are available to be won throughout the entire promotional period. There will be no fixed number of online instant wins each day or week. Prizes will roll over from day to day and week to week, until the end of the promotion and thus are available to be won at any point throughout.

29.    Instant Win online winners only, will be notified of their win instantly on screen and via the email address provided upon entry, to confirm the claim process and the method of receiving the prize. The email will be sent within 48 hours of the on-screen win notification. Winners will have 14 days from the date of the email to claim their prize. There will be a request for further information such as proof of ID and request/confirm address, together with discussions regarding proof of purchase submitted. 

30.    The winners of E-readers and the Speakers will need to submit as part of the claim process, proof of purchase details which must be unique, clearly indicate the product purchased and be dated within the Promotional Period and before entry. The Promoter will reserve the right to refuse any uploaded proof of purchase /till receipts that:
a.    Are out of focus / blurry;
b.    Do not have the correct product clearly visible;
c.    Show a purchase date outside of the Promotional Period or before entry date;
d.    Show store locations in geographical locations outside the stated promotional area; or
e.    Are not unique to the individual.

31.    It is the responsibility of entrants to check junk/spam folders to ensure they are in receipt of any communications.

32.    The Promoter will make reasonable efforts to contact the winners and then after successful contact, to receive information to allow fulfilment of the claim and to arrange the prize dispatch. Regular reminder emails (up to 3) will be sent out to winners until they either redeem their prize in full or the Promoter forfeits the prize. Inaccurate information may result in the prize being forfeited. If a winner has not responded to notifications after 14 days following confirmation or if a selected winner is ineligible, otherwise in breach of these Terms and Conditions, or unable to take up the prize for any other reason, the Promoter reserves the right to withdraw the prize and to forfeit this original win to them. Winners should retain their notification email message until their win has been verified.

33.    E-readers & Portable speakers, will be dispatched within 28 working days of the confirmation of each winner’s additional information, including postal address and any other information required.  The Audiobook service subscription (E-Gift), and the Magazine E-Gift cards will be fulfilled via the email address provided on entry. If circumstances change the Promoter will endeavour to keep the winners informed of dispatch details.


34.    The Late draw will take place on 03.01.23 with the winners being contacted within two (2) working days of the draw taking place.  There will be a request for further information such as proof of ID and request/confirm address, together with discussions regarding proof of purchase submitted. If a winner has not responded to notifications after 14 days following confirmation or if a selected winner is ineligible, otherwise in breach of these Terms and Conditions, or unable to take up the prize for any other reason, the Promoter reserves the right to withdraw the prize and to forfeit this original win to them and allocate the prize to a reserve drawn next in line. Winners should retain their notification email.


35.    Once verified, all winners will receive details of the likely despatch times for their prize (physical or digital). All prizes will be despatched within 28 days of the respective prizes being confirmed and the completion of any verification process. 


36.    No guarantee all prizes will be won during the main promotional period. Any remaining Instant Win prizes not won, or any Instant Win prizes that remain unclaimed following the close of the main promotional period, will be re-allocated to the Late Draw. The Late Draw will be drawn first followed by any unclaimed Instant Win prizes. 

37.    Winners will be subject to a full verification process. 

38.    Proof of entry/claim is not proof of purchase. Responsibility cannot be accepted for any requested claims that are lost, damaged, or delayed, nor any associated costs to entrants.

39.    The process of selecting any winners will follow the guidelines in these Terms and Conditions.

41.    Entrants are encouraged to monitor their system connections regularly during this time in case they are a winner.


42.    Only valid unique promotional codes from this promotion will be accepted. All promotional codes and entries are subject to verification. Promotional codes have no cash value and may not be sold or exchanged. Other manufacturer's information, references or printing errors do not constitute codes.

41.    The Promoter does not assume any responsibility for promotional codes damaged or defaced in the way the product packaging is opened. If a consumer cannot read their promotional code due to a genuine printing error or If you are unable to read your code or it is incomplete, please call the consumer helpline: Consumer helpline: Freephone 0800 585759 (Monday – Friday, 9am – 5pm) where your request will be logged and reviewed pending a replacement code being sent.

43.    After 23.59 on 31.08.22 all unredeemed codes will be invalid for entry into the Main Promotion (as the Main Promotional period has then ended), but codes may still be entered via until 23.59 on 31.12.22 for a chance to WIN in the Late Draw, 100 Magazine E-Gift cards. After 23.59 on 31.12.22 unredeemed promotional codes will be invalid (as the Late Draw period has then ended).

44.    All promotional codes are unique, and each valid code can only be entered and redeemed once. Once entered and redeemed, codes will be rendered void for further entry attempts. Any attempt to enter a code more than once will disqualify entry and any potential prize award will be forfeited.


General

45.    The Promoter is not responsible for the acts or default of third-party suppliers but will endeavour to resolve any issues that may arise.

46.    The Promoter’s decision is final with regards to all promotional matters.

47.    If fulfilment or any element of this promotion is delayed or affected due to the continuing Covid-19 pandemic and resulting Government restrictions, all entrants affected will be contacted by the Promoter and kept updated of any unavoidable changes to the promotion. 

48.    All entrants will be required to provide a genuine email address that is personal, valid, and accessible throughout the promotion. In the event that the specified information is not provided or is incorrect or an alias, the entry may be considered incomplete and therefore the Promoter reserves the right to invalidate the entry.

49.    In the event of an email address becoming inaccessible during the promotion, the Promoter is not able to retrieve and amend any existing entries to a new email address.


50.    Limitations of liability: Neither the Promoter, its agents or anyone professionally connected to the promotion, assume any responsibility or liability for:

a.    Any incorrect or inaccurate entry of information, or for any faulty, erroneous or failed electronic data transmissions;
b.    Any communications line failure, regardless of cause, with regards to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this promotion;
c.    Inaccessibility or unavailability of the internet or the microsite or any combination thereof; or


51.    If, for any reason, any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion modify or suspend the promotion or invalidate any affected entries. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.

52.    The Promoter reserves the right to verify all entries including but not limited to asking for receipt/proof of purchase, proof of packaging, code, address and identity details in the form of a copy of a current passport or driver’s licence (which they must provide within 7 calendar days) and to refuse to award a prize or withdraw prize entitlement, and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any instructions forming part of this promotion’s entry requirements or otherwise, where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means. The Promoter will be the final arbiter for all decisions, which are final and binding. It will not respond to any correspondence.

53.    Subject to Nestlé’s Privacy Policy, the surnames, counties and details of prize of verified main prize winners will be available upon request by sending an email to consumer.services@uk.nestle.com with the subject line ‘WINNERS LIST: NESCAFÉ Gold Frothy Win Your Me-Moment promotion’, for a period of 3 months following the end of the promotion. The Promoter reserves the right to refuse any or all such requests. When contacting this email address, your request will be actioned in line with Nestlé’s Privacy Policy. At the point of personal data collection for verification, all winners will be given the option to opt-in to having their first name, county, and prize type used for marketing purposes. If any winner subsequently objects to their information being published or used for marketing purposes, then they can contact the Promoter by emailing UKI.dataprotection@uk.nestle.com with the subject line ‘NESCAFÉ Gold Frothy Win Your Me-Moment promotion’. We may nevertheless disclose the information to the Advertising Standards Authority if required to do so.

54.    The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.


55.    If any of these clauses should be determined to be illegal, invalid, or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.

56.    The Promotion and these Terms and Conditions will be governed by the laws of the participating country and any disputes as to the meaning of these terms will be subject to the exclusive jurisdiction of the participants’ local courts.


Data Protection

57.    The Promoter will only use the personal details supplied for the administration of the promotion and the auditing of the entries where necessary and for no other purpose, unless we have your consent/you have opted-in to receive future marketing communications. All irrelevant data will be deleted three (3) months after the initial promotional period, and all data will be deleted three (3) months after the Late Draw. The surnames and counties of verified winners will be made available as set out in Clause 58 above and winners can object to this by emailing UKI.Dataprotection@uk.nestle.com. Otherwise, your personal details will at all times be kept confidential and in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018 as applicable. By participating in the promotion, you agree to the use of your personal data as described here. You can withdraw your consent at any time.
