NESCAFÉ RICOFFY n’ICE Competition_Jan 2021

 

  1. Introduction
     
    • 1.1. Participation in this Competition is governed by these terms and conditions (the “Rules”).
    • 1.2. Participants are encouraged to review the Rules before entering the competition and acknowledge that they have been given an appropriate opportunity to do so and that they understand and accept these Rules.
    • 1.3. This competition is operated by Nestlé (South Africa) (Proprietary) Limited (Nestlé) in conjunction with Boomtown (Pty) Ltd (the Promoters).
    • 1.4. Participation in the Competition constitutes acceptance of these Rules and Participants agree to abide by these Rules.

  2. By participating in this Competition, Participants agree to the rules set out below.

    2.1. This Competition is limited to legal residents and/or legal citizens of the Republic of South Africa. In addition, the following people shall not be eligible to participate in this Competition:
    • 2.1.1 Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoters.

    • 2.1.2. People who are not legal residents and/or legal citizens of the Republic of South Africa.

    • 2.1.3. Spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified above
    • 2.1.4. Persons under the age of 18 years.

    • 2.2. The Competition shall commence on 7 December 2020 and will end on 31 December 2020 at midnight. No entries received after 31 December 2020 will be considered.
  3. This Competition shall commence on 04 January 2021 and will end on 31 March 2021. No entries received after 31 March 2021 be considered.


  4. Mechanics:
     
    • 4.1. The Competition has 3 phases with specific hashtags for consumers to use for each phase.
    • 4.2. By sharing content on social media using any of the Competition hashtags:

    • #NESCAFERICOFFYNICE,
      #RICOFFYNICESUMMERSONG,
      #RICOFFYNICEMOVESCHALLENGE,
      #NICESUMMERCOMBO.

    • 4.3. To participate in this competition must do the following:
    • 4.4. purchase a bottle of NESCAFÉ RICOFFY n’ICE and keep their slip as proof of purchase.

    • PHASE 1: 04 – 25 January 2021
    • 4.5.#RICOFFYNICESUMMERSONG
      • Duet on TikTok with the Producer sound to be shared on NESCAFÉ RICOFFY’s TikTok channel OR download the sound from the link and record a video of yourself singing your lyrics to share on your social media channels using the hashtag which will also be share on NESCAFÉ RICOFFY’s Facebook and Instagram social media platforms.

      • All entries for Phase 1 of the competition need to be shared by 25 January 2021

    • PHASE 2: 05 February – 28 February 2021
    • 4.6. #RICOFFYNICEMOVESCHALLENGE
      • Use the full song created by Ricoffy’s producer and Summer Song winner and dance to the choreography provided by Ricoffy’s choreographers on various social media platforms using hashtag #RICOFFYNICEMOVESCHALLENGE.

    • PHASE 3: 01 – 23 March 2021
    • 4.7. #NICESUMMERCOMBO
      • Participants are required through NESCAFÉ RICOFFY’s social media channels to share an image of themselves with a NESCAFÉ RICOFFY n’ICE, sharing it to their social media channels with the hashtag: #NICESUMMERCOMBO.

      •  
    • 4.8. NOTE: Profanity, offensive language, phrases or sayings are prohibited. If your video entry contains the use of offensive language, your entry will not be accepted.

  5. Prize:
     
    • Winners stand a chance to be featured in the various media (Summer song and summary video at the end of the campaign).
    • By participating in this promotion, the Participant authorises Nestlé, its holding companies, subsidiaries, affiliates, divisions, successors and assigns and those acting under its permission, to use, reproduce, modify, distribute, make available, store, publish or broadcast in any medium (including Internet and any other media), in any matter, on a world-wide basis, now or at any time in the future, in whole or in part, the content that I created (in particular, but not only texts, photographs, film/video, recipes, etc.

  6. How to claim your prize:
     
    • PHASE 1 WINNER SELECTION:
      • Judges will choose the winner during the week of 26 January 2021
      • The winner will be announced on 29 January 2021
      • The winner will be contacted via DM to share all relevant contact details with NESCAFE RICOFFY to facilitate linking up with the producer to create the song for Phase 2. The song needs to be recorded by the 5th of February 2021.

    • PHASE 2 WINNER SELECTION:
      • Judges will choose the winner during the week of 22 February 2021
      • The winner will be announced on 28 February 2021
      • The winner will be contacted via DM to share all relevant contact details with NESCAFE RICOFFY to facilitate linking up with the choreographer to create the dance move for phase 2.

    • PHASE 3 WINNER SELECTION:
      • Judges will choose the winner end of week of the 19th March 2021.
      • The winner will be announced on 23 March 2021


      •  
    • 5.1.At the time that a potential prize winner is identified, the potential prize winner will receive a direct message on Instagram or Facebook from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as, but not limited to a copy of his/her ID and/or driver’s licence.

    • 5.2.The Winner may be required to fill in a Winner Form and indemnity, which needs to be returned to the Promoters within 24 (twenty-four) hours of receiving the form.

    • 5.3 The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to the Promotors.

    • 5.4.If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner-up finalist will be deemed the potential prize winner subject to the terms and conditions herein.

    • 5.5.If the Promotors are unable to reach any of the potential prize winners after 3 (three) attempts made within 2 (two) working days of their name being drawn, or if the potential prize winner fails to submit any requested information or documentation within 48 hours of it being requested, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.

    • 5.6.The choice of service providers and vendors, including but not limited to courier companies is at the sole discretion of Promoters.

    • 5.7 Winners will be announced on Facebook and Instagram for the phases as follows:
      • Phase 1 on the 29 January 2021.
      • Phase 2 on the 28th February 2021
      • Phase 3 on the 23rd March 2021

  7. General
    • 7.1. The judges’ decision is final, and no correspondence will be entered into.

    • 7.2. The prize is not transferable. The prize will not be handed/awarded to a third party, but only to the verified prize winner

    • 7.3. By entering, a Participant acknowledges that personal information about the Participant will be shared with the Promoters and their agents to the extent necessary to conduct the Competition and for prizes to be delivered to prize winner.

    • 7.4. By entering this Competition, you authorize the Promoters to process the personal information of Participants for communication or statistical purposes. Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and Nestlé’s privacy policy.     • 7.5. The Promoters shall not be responsible for any lost, damaged, delayed, incorrect or incomplete entries for any reason whatsoever. Proof of sending will not be accepted as proof of receipt.

    • 7.6. The Promoter shall not be responsible for the failure of any technical element relating to this promotion that may result in an entry not being successfully submitted.

    • 7.7. Responsibility is not accepted for entries lost, damaged or delayed as a result of any network, computer or cell phone hardware or software failure of any kind. Proof of sending will not be accepted as proof of receipt.

    • 7.8. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 (CPA).

    • 7.9. All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.

    • 7.10. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.

    • 7.11. TThe Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.

    • 7.12. The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Promotion and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.

    • 7.13. By entering the Competition, Participants acknowledge that the Promotion will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.

    • 7.14. Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Competition for whatsoever reason, all of the Promoters' obligations in regard to the Competition as well as in regard to the prizes shall cease to exist.

    • 7.15. Facebook and/or Instagram and/or TikTok and/or Twitter: This Competition is in no way organised, endorsed or administered by, or associated with, Facebook and/or Instagram and/or TikTok and/or Twitter. You understand that you are providing your information to the Promoters and not to Facebook and/or Instagram/ and/or TikTok and/or Twitter.

    • 7.16. It is a condition of participating in the Competition that the Participant warrants that their Submission is original and does not infringe the intellectual property of any third parties. The Participant assigns all rights, title and interest in their Submission to Nestlé without compensation. The Participant further agrees not to object to Nestlé’s use and/or implementation of the Submission. Nestlé may, if required request that a Participant complete any documentation necessary to give effect to this assignment of right, title and interest of the Submission to Nestlé.

    • 7.17. Nestlé reserves the right at its own discretion without having to give reasons for this to immediately remove any Submission or disqualify a Participant if his/her Submission or any aspect thereof is alleged to be an infringement of any 3rd party’s rights, including intellectual property rights such as copyright, patents, designs, trademarks, confidential information, etc. If this happens, Nestlé will not be legally responsible to any person and the winner will forfeit the prize or the remaining value thereof. Nestlé does not have to investigate the validity of such 3rd parties’ complaints before exercising these rights.

    • 7.18. The Participant agrees to hold Nestlé harmless against any claims by parties that his/her Submission or any aspect thereof infringes their rights in any way. This means that if Nestlé is sued, the Participant will, at Nestlé’s discretion, defend Nestlé against such claims and/or pay back any legal costs or expenses, or amounts Nestlé paid or must pay in damages to any person or to settle any claim, back to Nestlé. Legal costs and expenses will be calculated on an attorney and own client scale. It will be the Participant’s sole responsibility to conduct, at his/her cost and prior to submitting his/her entry for the Competition, all the necessary checks to determine whether his/her Submission or any aspect thereof infringes any third party’s rights.

    • 7.19. These Rules shall be governed by and interpreted according to the laws of the Republic of South Africa and any Participant and Nestlé consent to the non-exclusive jurisdiction of the High Court of South Africa.

    • 3.2. Participants may enter the competition as many times as they wish over the promotional period, provided they adhere to the above mechanic.
    • 3.3. Only one prize per person and per household will be permitted.

  4. The Prizes:
     
    • Participants who enter stand a chance to WIN 1 of 20 Limited Edition NESCAFÉ Iced Coffee boxes.
    • 4.2. Each NESCAFÉ Iced Coffee Box consists of:
      • 12 x NESCAFÉ Iced Coffee cans
      • 1 x NESCAFÉ branded ice buckets
      • 1 x NESCAFÉ branded playing cards
      • 1 x NESCAFÉ branded portable Bluetooth speaker
    • 4.3. Winners will be selected from the submitted content with the hashtag: #NESCAFÉIcedCoffee by the Promoters at least 14 days after the competition end date.
    • 4.4. None of the Promotion prizes are transferable or redeemable for cash and the Promoter is not liable for any defect, changes and/or modifications in the Prize.
    • 4.5. The Prizes are non-negotiable and cannot be exchanged.
    • 4.6. Prize visuals on any competition and/or promotional materials are for illustrative purposes only.
    • 4.7. The Promoters are not responsible for any risk and / or damages that may occur once any of the prizes are handed over to the winner(s).

    • 6.2. The Promoters may require the winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules.

    • 6.3. Should the winner be found, in the Promoters sole discretion: not to be eligible to win; not to have complied with these Rules; their conduct can be reasonably interpreted as scamming; acted fraudulently with regards to the Competition; and if it would be unlawful to award the prize, he/she will automatically be disqualified, and/or the prize will be forfeited. The Winner may also be required to sign acceptance of prizes and indemnity documents.

    • 6.4. The prize is not transferable, and no substitution or cash redemption of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize winner.

    • 6.5. The Promoters reserve the right, at their sole discretion, to substitute the prize with any other prize of comparable or greater commercial value for whatever reason.

    • 6.6. By entering this Competition, you authorize the Promoters to process the personal information of Participants for communication or statistical purposes. Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and Nestlé’s privacy policy.     • 6.7. By entering, a Participant acknowledges that personal information about the Participant will be shared with the Promoters and their agents to the extent necessary to conduct the Competition and for prizes to be delivered to prize winner.
    • 6.8. Participants may be required to take part in publicity campaigns for broadcast or publishing purposes. Participants shall always be entitled to decline the above request. Participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the Promoters.

    • 6.9. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 (CPA).

    • 6.10. All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or willful misconduct of any of the Promoters.

    • 6.11. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.

    • 6.12. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.

    • 6.13.The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Promotion and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.

    • 6.14. By entering the Competition, Participants acknowledge that the Promotion will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.

    • 6.15. Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Competition for whatsoever reason, all of the Promoters' obligations in regard to the Competition as well as in regard to the prizes shall cease to exist.

    • 6.16. Instagram: This Competition is in no way organized, endorsed or administered by, or associated with, Instagram. You understand that you are providing your information to the Promoters and not to Instagram.

    • 6.17. Facebook: This Competition is in no way organized, endorsed or administered by, or associated with, Facebook. You understand that you are providing your information to the Promoters and not to Facebook.

    • 6.18. These Rules shall be governed by and interpreted according to the laws of the Republic of South Africa and any Participant and Nestlé consent to the nonexclusive jurisdiction of the High Court of South Africa.
