Terms and Conditions

1. The promoters are Nestlé (South Africa) (Pty) Ltd and Shoprite Checkers (Pty) Ltd (“the Promoters”).

 

2. The promotional competition is open to all South African residents who are in possession of a valid South African identity document, passport or document of proof of South African residency. Any director, member, partner, employee, agent or consultant of the Promoters, the marketing service providers or any person who directly or indirectly controls or is controlled by these entities, including their spouses, life partners, business partners or immediate family members may not enter or participate in this promotional competition and will automatically be disqualified upon entry.

 

3. This promotional competition is open from 1 September 2021 and ends at 12am (midnight) on 30 September 2021. Any entries received after the closing date will not be considered.

 

4. To enter, participants are required to:

4.1 Purchase any 2 (Two) of the participating NESCAFÉ CLASSIC products* from any participating Checkers or Checkers Hyper branded store nationwide; and

 

4.2 Swipe their Xtra Savings Card to receive an automatic entry.

5. Participants must keep their till slip as proof of purchase.

 

6. Participants must ensure that their contact details are up to date on their Xtra Savings profile. If a winner’s details are not complete or accurate the Promoter cannot be held liable for a voucher not being received.

 

7. Participants may enter as many times as they wish provided that each entry is associated with a separate purchase and separate Xtra Savings Card swipe.

 

8. The prize is a chance to win 1 (One) of 10 (Ten) Checkers vouchers valued at R3000.00 (Three Thousand Rand) each. Note that the full value of the voucher must be used in one purchase and cannot be used at multiple intervals. 9. The voucher will be loaded onto the winner’s Xtra Savings Card and will be valid for 30 (Thirty) days after the voucher has been loaded.

 

10. Winners will be selected by means of a random draw no later than 4 (Four) weeks after the competition has ended. Winners will be notified by SMS and will receive their voucher containing their LPRO code to be used in store or put on a gift card.

 

11. A copy of these rules can be found on the following website: www.termsconditions.co.za or can be obtained from the Consumer Call Centre on telephone number 011 514 6789 throughout the period of the promotional competition. The onus rests on the participants to check the website for updates to the terms and conditions.

 

12. Winners will be required to sign an Indemnity and Media Release forms to the extent applicable.

 

13. Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and the Promoters’ respective privacy policies.

 

14. The Promoters shall not be responsible for any lost, damaged, delayed, incorrect or incomplete entries for any reason whatsoever. Proof of sending of an entry will not be accepted as proof of receipt of such entry.

 

15. The Promoters shall not be responsible for the failure of any technical element relating to this promotion that may result in an entry not being successfully submitted.

 

16. The Promoters reserve the right to disqualify any entry if any act of fraud or dishonesty is suspected, including without limitation, through the manipulation of code or otherwise frequently falsifying data.

 

17. The Promoters have the right in its sole discretion to summarily disqualify a winner who, at any time, does not act in accordance with the spirit of the promotional competition. A disqualified winner shall immediately forfeit their right, title or interest in any prize.

 

18. The prizes are not transferable and cannot be exchanged for cash.

 

19. The Promoters reserve the right to use the images taken of the winners in this competition for publicity purposes in any manner they deem fit, without remuneration being made payable to the winner. However, a winner has the right to object to these images being used by written notification to the Promoter at consumer.services@za.nestle.com or call us on +27 86 009 6116/+27 11 514 6116.

 

20. The Promoters shall have the right to change or terminate the promotional competition immediately and without notice, if deemed necessary in its opinion and if circumstances arise outside of their control. In the event of such change or termination, all participants agree to waive any rights that they have in respect of this promotional competition and acknowledge that they will have no recourse against the Promoters or their agents.

 

21. Neither the Promoters, its agents, its associated companies, nor any directors, officers or employees of such, shall be liable for any loss or damage, whether direct, indirect, consequential or otherwise arising from any cause whatsoever, which may be suffered by the participant.

22. The judges’ decision is final and no correspondence will be entered into.

 

23. Participation in the promotional competition constitutes acceptance of the promotional competition rules and participants agree to abide by the rules.

 

24. All information on the website, digital channels and till slip is provided by Shoprite Checkers (Pty) Ltd, or is licensed from various license holders. You may only use this information to assist in learning more about any particular product or service. You may not store, reuse or utilise this information for any commercial purpose.

 

25. You may not use any form of automated search or download technology to access this site without our prior written consent.

 

26. By accepting the terms and condition as set out herein, you confirm that you are aware of the information that is being collected by us and that this information will be solely processed for the purposes of this promotion.

1. Introduction

  • 1.1. Participation in this Competition is governed by these terms and conditions (the “Rules”).
  • 1.2. Participants are encouraged to review the Rules before entering into the Competition and acknowledge that they have been given an appropriate opportunity to do so and that they understand and accept these Rules.
  • 1.3. This competition is operated by Nestlé (South Africa) (Proprietary) Limited (“Nestlé”) in conjunction with Jupicorp (Pty) Ltd t/a TMARC ("TMARC”) (the “Promoters”).
  • 1.4. Participation in the Competition constitutes acceptance of these Rules and Participants agree to abide by these Rules. By participating in this Competition, Participants agree to the rules set out below.

2. This Competition is limited to legal residents and/or legal citizens of the Republic of South Africa. In addition, the following people shall not be eligible to participate in this Competition:

  • 2.1. Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoters.
  • 2.2. Spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified above.
  • 2.3. People who are not legal residents and/or legal citizens of the Republic of South Africa.
  • 2.4. Persons under the age of 18 years.

3. The Competition shall commence on 1 September 2021 and will end on 30 September 2021. No entries received after 30 September 2021 will be considered.

 

4. Mechanics

  • 4.1. To participate in this Competition, Participants must buy any 2 participating NESCAFÉ CLASSIC participating products at any SPAR that provides a proof of purchase in one transaction, then dial 120*27263# and follow the onscreen prompt. The USSD entry mechanic costs 20c per 20 seconds. The participants should retain their proof of purchase to claim their prize. Participants can enter as many times as they want.

  • 4.3. USSD sessions are charged from your airtime or billing balance and costs 20c for every 20 seconds you use the service (Free minutes do not apply.) The average time for entry is under 20 seconds so your call should not exceed more than 40 seconds. Please ensure you terminate the call when complete in order to stop the call.

4.4. Participants may enter the competition as many times as they wish over the promotional period, provided that Participants purchase the participating products each time and complete the competition entry and enter a new barcode, subject to the following conditions:

  • 4.4.1. All entries from disqualified participants’ mobile numbers will be rejected
  • 4.4.2. Only one prize per household and per person
  • 4.4.3. No computer-based entries will be accepted
  • 4.4.4. Only 1 win per unique MSISDN
  •  
  • 4.5. Any mobile number that enters an incorrect barcode code five (5) times in succession will be locked out of the Competition for the entire duration of the promotional competition (“Blocked Participants”).
  • 4.6. Blocked Participants have an opportunity to call the Nestlé Call Centre on 011 514 6116 or 086 009 6116 between 09h00 – 16h30 Monday to Friday should there be a valid reason, which is accepted by the Promoter, for the Blocked Participants to be allowed to enter the Competition.
  • 4.7. Participants must enter on a Mobile phone that is owned and registered to that person. No other person can use another person’s Mobile phone for Competition entry purposes. If it is discovered that participants have entered on a phone that is not registered to them, they will be disqualified and the entrant will be requested to refund the prizes to the Promoters.
  • 4.8. The cellphone number is key to all entries, if the entrant has won on a cellphone number they cannot use another number in order to be contacted further, this number needs to be a number that is contactable during office hours.
  • 4.9. Participants must enter a valid South African identity number (ID number) or valid permanent residency permit number and this is key to all entries. No person can use another person’s identity/permit number for competition entry purposes. If it is discovered that participants have entered an identity/permit number that is not theirs, they will be disqualified, and the entrant will not be eligible for the prize.

5. The Prizes:

Participants stand a chance to win 1 (one) of 10 (ten) SPAR shopping voucher to the value of R3000 (three thousand Rand) each valid for a period of 90 (ninety) days upon issuance.

6. How to claim your prize:

  • 6.1. lucky winners will be drawn at random in the presence of the Nestlé brand team, the TMARC and Nestlé legal team. These draws will take place Monday 04 October 2021.
  • 6.2. At the time that a potential prize winner is identified, the potential prize winner will receive an SMS message in their cell phone number from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents and a copy of his/her ID and/or driver’s license to the Promoters’ representative.
  • 6.3. The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to the Promoters. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
  • 6.4. If the Promoters are unable to reach any of the potential prize winners after 3 (three) attempts made within 3 (three) working days of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein
  • 6.5. Potential prize winners will have 48hrs from the time of being contacted to supply any required documentation / proof of purchase.
  • 6.6. Validated winners will have their prizes delivered by a representative of the Promoters. Should delivery of the prizes be unsuccessful after 3 attempts the prizes will be stored at TMARC and may be collected by the validated winner. Winners must allow for 4 weeks from the time of being notified they are a winner to receipt of the prize.
  • 6.7. It is the responsibility of the winners to provide delivery details and availability times that are accurate. Failure to do this will result in the winner having to collect the prize from the premises of TMARC if delivery fails for any reason whatsoever.
  • 6.8. No participant may be allowed to win more than one of the prizes on offer, nor will they be allowed to win a prize from more than one retailer participating in the Winter Treats and Winter Favourites campaign.
  • 6.9. Participants who have won one of the weekly prizes will not be entitled to win the Grand Prize

7. General

  • 7.1. The judges’ decision is final, and no correspondence will be entered into.
  • 7.2. The Promoters may require the winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules.
  • 7.3. Should the winner be found, in the Promoters sole discretion: not to be eligible to win; not to have complied with these Rules; their conduct can be reasonably interpreted as scamming; acted fraudulently with regards to the Competition; and if it would be unlawful to award the prize, he/she will automatically be disqualified and/or the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
  • 7.4. The prize is not transferable, and no substitution or cash redemption of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize winner.
  • 7.5. The Promoters reserve the right, at their sole discretion, to substitute the prize with any other prize of comparable or greater commercial value for whatever reason.
  • 7.6. By entering, a Participant acknowledges that personal information about the Participant will be shared with the Promoters and their agents to the extent necessary to conduct the Competition and for prizes to be delivered to prize winners.
  • 7.7. By entering this Competition you authorise the Promoters to collect, store and use (not share) personal information of Participants for communication or statistical purposes. You are entitled to decline any marketing communication by emailing consumer.services@za.nestle.com. Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and Nestlé’s privacy policy.
  • 7.8. Participants may be required to take part in publicity campaigns for broadcast or publishing purposes. Participants shall at all times be entitled to decline the above request. Participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the Promoters.
  • 7.9. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
  • 7.10. All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
  • 7.11. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
  • 7.12. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
  • 7.13. The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Competition and acknowledge that they will have no recourse against the Promoters, their advertising agencies, advisors, suppliers and nominated agents.
  • 7.14. By entering the Competition, Participants acknowledge that the Competition will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
  • 7.15. Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Competition for whatsoever reason, all of the Promoters’ obligations in regard to the Competition as well as in regard to the prizes shall cease to exist.
  • 7.16. These Rules shall be governed by and interpreted according to the laws of the Republic of South Africa and any Participant and Nestlé consent to the non-exclusive jurisdiction of the High Court of South Africa.

1 TERMS AND CONDITIONS

1.1 The promoters to this competition are Pick n Pay Retailers Pty Ltd (registration number: 1973/004739/07) a company incorporated in the Republic of South Africa and having its registered address at 101 Rosmead Avenue, Kenilworth, 7708 (“Pick n Pay”) and Nestlé (South Africa) Proprietary Limited (registration number: 1960/002377/07) a company incorporated in the Republic of South Africa and having its registered address at Anslow Office Park, 8 Anslow Crescent, Bryanston, Johannesburg 2021 (“Nestlé”) (NESTLÉ and Pick n Pay shall alternatively be referred to as the “promoters”).

1.2 All persons entering the Pick n Pay and NESCAFÉ CLASSIC Shopper CTP Competition (the “promotional competition”, alternatively the “competition”) (the “entrants") agree that the competition rules as set out in these terms and conditions are binding on them. 2 IMPORTANT NOTICE

2.1 These terms and conditions and competition rules contain certain terms and conditions which appear in similar text style to this clause and which:

 

2.1.1 may limit the risk or liability of the promoter or a third party; and/or

2.1.2 may create risk or liability for the entrant; and/or

2.1.3 may compel the entrant to indemnify the promoter or a third party; and/or

2.1.4 serves as an acknowledgement of a fact by the entrant.

 

2.2 The entrant's attention is drawn to these terms and conditions because they are important and should be carefully noted.

2.3 The entrant cannot be a juristic person and must be an individual.

2.4 Nothing in these terms and conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the entrant or the promoter in terms of the Consumer Protection Act, 68 of 2008 (the “CPA”).

2.5 The entrant acknowledges that by submitting his or her entry to the competition he/she has been given an appropriate opportunity to first read these terms and conditions before entering and that he/she understands and agrees to the terms and conditions.

2.6 All entrants to this promotional competition participate entirely at their own risk. By reading and accepting these terms and conditions, the entrant gives consent to these risks and hereby indemnifies and holds harmless the promoters, NESTLÉ, Pick n Pay and all entities in the Pick n Pay and NESTLÉ groups respectively, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any indemnified party.

 

3 RULES OF THE COMPETITION

3.1 This promotional competition opens on 01 September 2021 and closes on 30 September 2021.

3.2 The competition is open to all registered Pick n Pay Smart Shoppers nationally.

3.3 The prize:

3.3.1 One (1) of Ten (10) PnP vouchers to the value of Three Thousand Rands (R3000) each.

3.4 Ten (10) winners in total.

3.5 Prizes are not transferable and may not be exchanged for cash or other prizes.

3.6 The competition includes Pick n Pay online and Pick n Pay in-store shopping purchases of any two of the following NESCAFÉ CLASSIC

3.7 Entrants must purchase any two Participating Products in a single transaction and swipe their Smart Shopper Card to be entered into the competition.

3.8 In order to qualify as an entrant for this promotional competition, the entrant:

3.8.1 must live in the Republic of South Africa;

3.8.2 must provide correct and full personal details, as required;

3.8.3 must be 18 years old or older;

3.8.4 cannot be a juristic entity and must be an individual; and

3.8.5 must be a registered Pick n Pay Smart Shopper.

3.9 The promoters, NESTLÉ, Pick n Pay, any entity in the Pick n Pay and NESTLÉ Groups respectively or Company and their directors, members, partners, employees, agents or consultants, the suppliers of goods or services in connection with this promotional competition, or any other person who directly or indirectly controls or is controlled by the above named parties and their respective spouses, life partners, business partners or immediate family members are not permitted to participate in this promotional competition.

3.10 To enter the promotional competition, the entrant must Purchase any 2 NESTLÉ CERELAC, NESTLÉ CERELAC and/or NESTLÉ NESTUM and swipe their Smart Shopper card for automatic entry or buy any 2 participating products online for an automatic entry.

 

4 SELECTION OF WINNERS

4.1 Winners will be selected within four weeks of the competition closure date (this date is subject to change without notice).

4.2 Entrants to whom prizes will be awarded will be selected through a random draw.

4.3 Winners will be contacted via email or telephonically within four weeks of the competition closure date (this date is subject to change without notice). Pick n Pay and NESTLÉ reserve the right to disqualify a winner if he/she does not respond to the email or telephone call within one week of winner selection and randomly select a replacement winner from the competition entries. In such circumstances, the replacement winner shall be contacted via email or telephonically by Pick n Pay as soon as reasonably practicable and shall be required to respond to Pick n Pay in the manner set out in such correspondence. In the event that the replacement winner fails to respond to Pick n Pay as required, then the provisions of this clause shall apply to that new winner in the same way as if he/she were the original winner. If the selected winner does not have any contact details a redraw will need to take place immediately.

4.4 Pick n Pay and NESTLÉ reserve the right to amend the terms and conditions as well as terminate the Competition at any time. In the event of such termination, all participants agree to waive any rights that they may have in terms of the Competition and acknowledge that they will have no recourse against Pick n Pay, NESTLÉ, their advertising agencies, advisors, suppliers and nominated agents.

 

5 GENERAL

5.1 By entering the competition in accordance with its terms, you are entering a promotional competition for the purposes of the Consumer Protection Act, 2008 ("CPA") and the promotional competition will be conducted in accordance with the relevant provisions of the CPA. Should you win a prize in the competition, you undertake to expeditiously do all things necessary to enable the promoter/sponsor to comply with its obligations under the CPA including, but not limited to (i) providing such personal information as may be required in order to facilitate handing over the prize (including providing proof of address and identity number) and (ii) signing receipt of the prize upon its delivery.

5.2 The names of the prize winners will be published on the Pick n Pay and NESTLÉ Websites, subject to the winners’ consent.

5.3 Winners may be requested to take part in the promoter's publicity campaigns or to allow their names and likenesses to be used by the promoter for promotional purposes. Winners are, however, entitled to decline such request.

5.4 The promoters shall conduct the competition, and the Promoters’ decision on any matter related to the competition, including the selection of prize winners is final and no correspondence will be entered into. 5.5 A copy of these rules can be found at www.picknpay.co.za.   5. How to claim your prize:
     
    • 5.1. Judges will choose the winners via random draw on 3rd August 2021 and verify the winners as per the below process.
    • 5.2. The verified winners will be announced 6th August 2021. (This date is subject to change at the sole discretion of the Promoters) on NESCAFÉ RICOFFY digital platforms on Facebook, Instagram and Twitter.

    • 6.10. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.

    • 6.11. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.

    • 6.12.The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Promotion and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.

    • 6.13. By entering the Competition, Participants acknowledge that the Promotion will be managed in accordance with the provisions of the CPA. Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Competition for whatsoever reason, all of the Promoters' obligations in regard to the Competition as well as in regard to the prizes shall cease to exist.

    • 6.16. It is a condition of participating in the Competition that the Participant warrants that their Submission is original and does not infringe the intellectual property of any third parties. The Participant assigns all rights, title and interest in their Submission to Nestlé without compensation. The Participant further agrees not to object to Nestlé’s use and/or implementation of the Submission. Nestlé may, if required request that a Participant complete any documentation necessary to give effect to this assignment of right, title and interest of the Submission to Nestlé.

    • 6.17. Nestlé reserves the right at its own discretion without having to give reasons for this to immediately remove any Submission or disqualify a Participant if his/her Submission or any aspect thereof is alleged to be an infringement of any 3rd party’s rights, including intellectual property rights such as copyright, patents, designs, trademarks, confidential information, etc. If this happens, Nestlé will not be legally responsible to any person and the winner will forfeit the prize or the remaining value thereof. Nestlé does not have to investigate the validity of such 3rd parties’ complaints before exercising these rights.

    • 6.18. The Participant agrees to hold Nestlé harmless against any claims by parties that his/her Submission or any aspect thereof infringes their rights in any way. This means that if Nestlé is sued, the Participant will, at Nestlé’s discretion, defend Nestlé against such claims and/or pay back any legal costs or expenses, or amounts Nestlé paid or must pay in damages to any person or to settle any claim, back to Nestlé. Legal costs and expenses will be calculated on an attorney and own client scale. After providing the telephone/cellphone number, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as proof of purchase (receipt/s) and a copy of his/her South African ID and/or driver’s license to the Promoters representative. 

 

    1. A potential prize winner is not an actual winner at the time of being contacted. Contact is made with a potential prize winner to ensure that the required receipt/s is available. Once the till slip has been supplied and validated, the mobile number of the potential winner is placed into a randomised draw process from which they could be selected as the final winner. The final winner may be required to submit additional documentation as determined by the Promoters. NESTLÉ BOTSWANA - SHARE THE PRIDE RADIO CAMPAIGN 2021

  1. Introduction
     
    • 1.1. Participation in this Competition is governed by these terms and conditions (the “Rules”).
    • 1.2. Participants are encouraged to review the Rules before entering the Competition and acknowledge that they been given an appropriate opportunity to do so and that they understand and accept these Rules.
    • 1.3. This competition is operated by Nestlé (South Africa) (Proprietary) Limited (“Nestlé”) in conjunction with Dentsu Aegis Network SSA (Pty) Ltd (the “Promoters”).
    • 1.4. Participation in the Competition constitutes acceptance of these Rules and Participants agree to abide by these Rules.

  2. By participating in this Competition, Participants agree to the rules set out below.

    This Competition is limited to residents and/or legal citizens of Botswana. In addition, the following people shall not be eligible to participate in this Competition:
    • 2.1. Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoters.
    • 2.2. People who are not legal residents and/or legal citizens of Botswana.

  3. The competition shall commence on 18 June 2021 and will end on 30 July 2021 (the “promotional period”). No entries received after 30 July 2021 will be considered.
  4. Mechanics:
     
    • To participate in the competition, participants must:
    • 4.1.2. Call into or send a voice note to any of the following radio stations (Duma FM, Gabza FM and/or RB2) every Friday throughout the promotional period.

    • 4.1.3. Randomly, throughout the day (Friday), the radio stations will play the sound of a boiling kettle. When listeners hear this, they will need to call the station or send a voice note as quickly as possible and tell the radio DJ how they make the perfect cup of NESCAFÉ RICOFFY.
    • 4.1.4. The first 2 listeners to call and to share how they make the perfect cup of NESCAFÉ RICOFFY stand a chance to win a 2000 Pula cash prize each.
    • 4.1.5. The next 2 listeners to either call or send a voice note to the show to share how they make the perfect cup of NESCAFÉ RICOFFY stand a chance to win a 1000 Pula data voucher each.
    • 4.2. Participants may enter the competition as many times as they wish over the promotional period, subject to the condition that only one prize per household and per person will be permitted i.e. within the same family or immediate family residing in the same abode and each participant may only win one prize throughout the promotional period.

  5. The Prizes
    • 5.1. Participants stand a chance to win 2 x 2000 Pula cash prizes every Friday to the total value of 24 000 Pula on each radio station and 2 x 1000 Pula data vouchers to the total value of 12 000 Pula for the duration of the promotional period.
    • 5.2. For the avoidance of doubt, a total of 12 prizes will be up for grabs between all 3 radio stations, with each radio station giving away 2 x 2000 Pula cash prizes and 2 x 1000 Pula data vouchers.
    • 5.3. A total of 36 x 2000 Pula cash prizes and a total of 36 x 1000 Pula data vouchers will be given away for the duration of the promotional period.

  6. How to claim your prize:
     
    • 6.1. The radio station will award the prizes according to the above mechanics.
    • 6.2.At the time that a potential prize winner is identified, the potential prize winner’s details will be recorded by the radio station and passed on to the Promoters. Once the Promoters receive the details, the potential winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as a copy of his/her ID document to the Promoters representative.
    • 6.3.The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to Nestlé. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up will be selected, subject to the terms and conditions herein.
    • 6.4. Winners of the Prizes will be need to have a valid bank account for the cash prize to be deposited into and proof of banking details to be shared with the promoters.
    • 6.5. The winner will need to produce valid identification on redemption of their prize.

  7. General
     
    • 7.1. Each draw is final, and no correspondence will be entered into. Nestlé and/or any of its agencies may refuse to award a prize to a participant if there is suspicion of any irregularities or fraudulent activities.

Only 1 (one) prize may be awarded to each participant per week.
    • 6.2. The prizes are not transferable, and no substitution or cash redemption of prizes is permitted. A prize will not be handed/awarded to a third party, but only to the verified prize winner.

    • 7.2.2. The potential prize winner will be required to fill in a Winner Form and indemnity, which needs to be returned to the Promoter within 24 (twenty-four) hours of receiving the form.

    • 8.5. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
    • 8.6. All Participants participate entirely at their own risk. By reading and accepting these Rules, each Participant gives consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or willful misconduct of any of the Promoters.
    • 8.7. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by a Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
    • 8.8. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
    • 8.9. The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Promotion and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.
    • 8.10. By entering the Competition, Participants acknowledge that the Promotion will be managed in accordance with the provisions of the CPA. Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary.   1. Introduction
    • 1.1. Participation in the NESCAFÉ Gold Cappucino Competition is governed by these terms and conditions (the “Rules”).
    • 1.2. Participants are encouraged to review the Rules before entering into the Competition and acknowledge that they have been given an appropriate opportunity to do so and that they understand and accept these Rules.    
    • 1.3. This Competition is operated by Nestlé (South Africa) Proprietary Limited (“Nestlé”) in conjunction with the TTG Communications Group (Pty) Ltd. t/a Two Tone Global (the “Promoters”).
    • 1.4. Participation in the Competition constitutes acceptance of these Rules and Participants agree to abide by these Rules.

 

  1. Competition Participation:

By participating in this Competition, Participants agree to the rules set out below:

  • 2.1.This Competition is limited to legal residents and/or legal citizens of the Republic of South Africa.
  • 2.2.In addition, the following people shall not be eligible to participate in this Competition:

Mangwanani and Sorbet vouchers are valid for 1 (one) year from date of issue. Yuppiechef, Camelot and Misty Hills vouchers are valid for a period of 3 (three) years from date of issue. Only 1 (one) prize may be awarded to each participant per week.
    • 6.2. The prizes are not transferable, and no substitution or cash redemption of prizes is permitted. A prize will not be handed/awarded to a third party, but only to the verified prize winner.

  1. Definitions
     
    • Unless the context provides otherwise, the words and expressions set out below will have the following meanings and cognate expressions shall have corresponding meanings:

    • 1.1. “Competition” means the NESCAFÉ CLASSIC Radio Hamper Competition, organised by NESTLÉ (South Africa) (Proprietary) Limited (“NESTLÉ”) in conjunction with Radio Kosmosand Radiowave(th“Competition Period” means start date 1stMay2021and end date 30thJuly 2021ending at 23h59 of the closing date.
    • 1.2. “Competition Period” means start date 1stMay2021and end date 30thJuly 2021ending at23h59 of the closing date.
    • 1.3. “Participant” means a person who enters the Competition.

  2. Application of Terms and Conditions
     
    • By choosing to enter the Competition, the Participant agrees to be bound by the following terms and conditions, which the Participant acknowledges to have read and understood.

    • 3.3.Entries received through any medium other than as stipulated in clause 3.2 shall not be considered

  4. Award Terms
    • 4.1. The winner of the Competition will be chosen by a random draw from eligible entries by the resident DJ.

  6. Warranties and Indemnities
     
    • The Promoter, its employees, officers, directors, agents and associates and the Participating Stores, their employees, officers, directors, agents and associates (the “Indemnified Parties’’) shall not be liable for and the Participants hereby indemnify and hold the Indemnified Parties harmless from any claim, liability, cost, expense or penalty suffered or incurred by any person as a result of participating in the Competition.
    • 6.2.All products given as part of the Prizes are subject to all applicable warranties, guarantees and instructions of use accompanying such products.

  7. Force Majeure
     
    • In the event of any act of God, strike, war, warlike operation, rebellion, riot, civil commotion, lockout, combination of workmen, interference of trade unions, suspension of labour, fire, accident, or (without regard to thefore going enumeration) of any circumstances arising or action taken beyond or outside the reasonable control of the Promoter preventing them from the performance of any obligation to a Participant(any such event hereinafter called "Force Majeure") then the Promoter shall be relieved of all such obligations to the Participant during the period that such Force Majeure continues and shall not be liable for any delay or failure in the performance of any obligations or loss or damage which the Participant may suffer due to or resulting from the Force Majeure.

  8. General
     
    • 8.1. The Promoter may in its sole and absolute discretion amend these terms and conditions at any time, by publishing the revised terms and conditions on the https://www.nescafe.com/za/competition-ts-cs
    • 8.2. The Competition is not open to any director, member, partner, owner, employee, agent of, consultant to, or anyone associated with or affiliated to the Promoter.

  1. How to claim your prize:

     

    1. Judges will choose the winners via random draw on the following dates 27th May 2021 and 05th July 2021 and verify the winners as per the below process.

       

    2. The verified winners will be announced 2nd June 2021 and 12th July 2021 

      (This date is subject to change at the sole discretion of the Promoters) on NESCAFÉ RICOFFY digital platforms on Facebook, Instagram and Twitter.

       

    3. At the time that a potential prize winner is identified, the potential prize winner will receive a direct message on Instagram, Facebook, Twitter or direct email from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as, but not limited to a copy of his/her ID and/or driver’s licence.

The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.

       

    11. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.

       

    12. The Promoters reserve the right to terminate or extend the Competition at any time. The final winner may be required to submit additional documentation as determined by the Promoter.   5. The Prizes
    • 5.1. Participants stand a chance to win 1 of 80 Urns (1 Urn per store) and 1 of 160 shopping vouchers(2 per store).Store shopping vouchers to be redeemed in the store of purchase, in person. The voucher will be valid for 6months from the date of issueand are valued at 369.66Pula.
    • 5.2. For the avoidance of doubt, a total of 80 winners will be chosen at the Prize Draw.

  6. How to claim your prize:
     
    • 6.1.     • 6.7. Should the winner not collect their prize from the relevant store within the 14-dayperiod stipulated above, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.

    • 7.5. All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoter, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoter.
    • 7.6. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limitor avoid any rights or obligations, as the case may be, created for either the Participant or the Promoter in terms of the Gambling Act, 07 of 2012 (the “Gambling Act”).

The Promoter, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
    • 7.8. The Promoter, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoter themselves.
    • 7.9. By entering the Competition, Participants acknowledge that the Promotion will be managed in accordance with the provisions of the Gambling Act.     • 7.9. All Participants participate entirely at their own risk.   1. Introduction
     
    • 1.1. Participation in this Competition is governed by these terms and conditions (the “Rules”).
    • 1.2. Participants are encouraged to review the Rules before entering the competition and acknowledge that they have been given an appropriate opportunity to do so and that they understand and accept these Rules.
    • 1.3. This competition is operated by Nestlé (South Africa) (Proprietary) Limited ( Nestlé) in conjunction with Boomtown (Pty) Ltd (the Promoters).
    • 1.4. Participation in the Competition constitutes acceptance of these Rules and Participants agree to abide by these Rules.

  2. By participating in this Competition, Participants agree to the rules set out below.

    2.1. This Competition is limited to legal residents and/or legal citizens of the Republic of South Africa. In addition, the following people shall not be eligible to participate in this Competition:
    • 2.1.1 Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoters.

    • 2.1.2. People who are not legal residents and/or legal citizens of the Republic of South Africa.

    • 2.1.3. Spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified above

  3. Mechanics:

    3.1.1 Consumers to purchase a 750g tin of NESCAFÉ RICOFFY; and

    • 3.1 Participants may enter the competition by doing the following :

  4. Prize:
    • 4.1 2 winners will be selected every 2 weeks (total of 4 winners) and they will receive a NESCAFÉ RICOFFY product hamper and R2000 cash each

  5. How to claim your prize:
     
    • 5.1.1. Judges will choose 2 winners on 2nd April 2021 and two winners 9th April 2021 and verify him/her as per the below process.
    • 5.1.2. The verified winners will be announced 7th April 2021 and 14th April 2021 on Facebook and Instagram.
    • 5.1.3. The winners will be contacted via DM to share all relevant contact details with NESCAFÉ RICOFFY.

Nestlé does not have to investigate the validity of such 3rd parties’ complaints before exercising these rights.

    • 6.18. The Participant agrees to hold Nestlé harmless against any claims by parties that his/her Submission or any aspect thereof infringes their rights in any way. This means that if Nestlé is sued, the Participant will, at Nestlé’s discretion, defend Nestlé against such claims and/or pay back any legal costs or expenses, or amounts Nestlé paid or must pay in damages to any person or to settle any claim, back to Nestlé.     • 3.2 NOTE: Profanity, offensive language, phrases or sayings are prohibited. If your video entry contains the use of offensive language, your entry will not be accepted.

    • 3.3 All entries for Phase 1 of the Competition need to be shared by 03 March 2021


    • PHASE 2

    • 3.4 Participants may enter phase 2 of the competition by doing the following:

    • 3.5 All entries for Phase 2 of the competition need to be submitted by 06 April 2021.

    • 5.7. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner-up finalist will be deemed the potential prize winner subject to the terms and conditions herein.

    • 6.9. All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.

    • 6.10. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.

    • 6.11. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.

    • 6.12. The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Promotion and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.

    • 6.13. By entering the Competition, Participants acknowledge that the Promotion will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.

Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary.     • 6.16. It is a condition of participating in the Competition that the Participant warrants that their Submission is original and does not infringe the intellectual property of any third parties. The Participant assigns all rights, title and interest in their Submission to Nestlé without compensation. The Participant further agrees not to object to Nestlé’s use and/or implementation of the Submission. Nestlé may, if required request that a Participant complete any documentation necessary to give effect to this assignment of right, title and interest of the Submission to Nestlé.

    • 6.17. Nestlé reserves the right at its own discretion without having to give reasons for this to immediately remove any Submission or disqualify a Participant if his/her Submission or any aspect thereof is alleged to be an infringement of any 3rd party’s rights, including intellectual property rights such as copyright, patents, designs, trademarks, confidential information, etc. If this happens, Nestlé will not be legally responsible to any person and the winner will forfeit the prize or the remaining value thereof. Nestlé does not have to investigate the validity of such 3rd parties’ complaints before exercising these rights.

    • 6.18. The Participant agrees to hold Nestlé harmless against any claims by parties that his/her Submission or any aspect thereof infringes their rights in any way. This means that if Nestlé is sued, the Participant will, at Nestlé’s discretion, defend Nestlé against such claims and/or pay back any legal costs or expenses, or amounts Nestlé paid or must pay in damages to any person or to settle any claim, back to Nestlé. Legal costs and expenses will be calculated on an attorney and own client scale.   5. How to claim your prize:
     
    • 5.1. Winners will be selected by way of random draws on:

    • 3.3. Only one prize per person and per household will be permitted.

  4. The Prizes:
