The following terms and conditions apply exclusively to the NESCAFÉ Sweet & Creamy Competition (the “Waawolo Challenge”).
By participating in the Waawolo Challenge, each Participant fully and unconditionally agrees to these Terms and Conditions (the “T&C’s).
These T&C’s may be reviewed at the Client’s discretion without any further recourse to the Participants. Participants are thus required to check the Client’s NESCAFÉ Ghana official Instagram and Facebook pages regularly for such changes. Changes shall be effective from the date they are uploaded unto the Client’s NESCAFÉ Ghana official Instagram and Facebook pages.
Participants acknowledge that they have read and understood and will comply with these T&C’s.
Eligibility
This Waawolo Challenge is open only to individuals aged eighteen (18) years and above.
The Waawolo Challenge shall be valid in Ghana and therefore participation is restricted to only persons who are legally resident in Ghana.
Employees of the Client and the Agency and their immediate families (including spouses, parents, children, and siblings), distributors and direct wholesalers of the Client, and all other suppliers and third parties directly involved with the facilitation of the Waawolo Challenge are NOT eligible to participate in the Waawolo Challenge.
The Agency reserves the right to disqualify a Participant who breaches the T&C’s hereof or otherwise fraudulently accesses the Waawolo Challenge or unfairly influences the course of the Waawolo Challenge.
Entry
Names: Participants must enter this Waawolo Challenge using their full legal name as stated on a valid national ID. The Agency reserves the right to disqualify any Participant who uses multiple names or any false names, and such Participants may be required to return to the Agency, any Prize they may have won.
Retrospective Effect: where a Participant that receives a Prize has not complied fully with the T&C’s or has been found to be in breach of any of the T&C’s of the Waawolo Challenge, particularly where a Participant is in breach of the entry restrictions, the Agency reserves the right to disqualify that Participant and require the return or reimbursement of any Prize even where the Prize has already been awarded and/or actually provided to the Participant in question.
Waawolo Challenge Period
The Waawolo Challenge starts on 9th June, 2021 at 00:00:01 GMT and ends on 13th of June 2021 at 23:59:59 GMT (the “Waawolo Challenge Period”).
The Agency reserves the right to extend the Waawolo Challenge Period as it deems necessary or cancel, discontinue, or suspend the Waawolo Challenge as well as vary the Prizes on the occurrence of any event beyond the control of the Agency and/or the Client with or without notice to the general public.
Waawolo Challenge Mechanics
To participate to the Waawolo Challenge, the Participant is required to buy a Nescafé Sweet & Creamy (3 in 1) 30g sachet at any outlet across Ghana, make a selfie video (the “Selfie Video”) of his or herself holding the empty sachet of the NESCAFÉ Sweet & Creamy (3 in 1) 30g and saying without pausing “Waaaaaaaaaaaaaaaaaaaaaaaa wolo!” for as long as he or she can.
After making the Selfie Videos, the Participants are to upload and post their Selfie Videos on their respective Instagram or Facebook pages and tag the NESCAFÉ Ghana official Instagram handle @nescafe_gh(https://www.instagram.com/nescafe_gh/) or the Nescafé official Facebook handle @NescafeGhana(https://www.facebook.com/NescafeGhana) with the following Hatags: #NESCAFÉWaawolo #WaawoloChallenge #NESCAFÉGhana #NESCAFÉSweetAndCreamy. Additionally, Participants are also required to tag their friends in their respective entries inviting them to join the Waawolo Challenge.
A Team will review the Selfie Videos submitted by the Participants and the five (5) selected entries with the longest “Waawolo” will receive various prizes (the “Prizes”).
Participants must ensure that all entries made into the Waawolo Challenge are original Selfie Videos taken by themselves and the said Selfie Videos are not the subject matter of any copyright infringements.
A Participant selected to receive a Prize will receive a call from the Agency for validation of his or her entry and verification of his or her identity.
The selection of Participants whose entries are to receive Prizes shall be determined at the end of the Waawolo Challenge Period and the said Prizes are NOT exchangeable for cash.
An individual can participate in the Waawolo Challenge only once during the Waawolo Challenge Period. Where a Participant makes multiple entries into the Waawolo Challenge the entry first in time of the said Participant shall be selected for consideration by the Team.
Prizes will be presented to the selected Participants at such time and place as the Agency may determine subject to the Client’s availability (date, time, and location to be communicated by the Agency).
Prizes are redeemable in Ghana only and are non-transferable. In the event a Participant selected to receive a Prize fails to redeem his/her Prize within fourteen (14) working days of notification, the Participant’s right to the Prize will automatically lapse.
A Participant who is selected to receive a Prize will be required to present a valid national ID card for verification prior to receiving the Prize.
Under no circumstances shall Participants be required to send money, airtime, or any other form of consideration (monetary or otherwise) to participate in the Waawolo Challenge and/or claim Prizes. Any requirement of such nature is fraudulent. The Agency and/or Client shall not be held liable for the acts of such fraudsters. Participants are entreated to report such activities by calling 0302 2211878.
The Agency and/or the Client shall further not be liable for:
Any technical failure or malfunction, or any other problem with any machine, telephone network or system, service provider, software or otherwise that may result in the inaccessibility of a Participant that is selected to receive a Prize or a lost or unrecorded entry.
Any copyright infringement as a result of a Participant’s entry into the Waawolo Challenge.
Any third-party claim for any damage arising out of any act of a Participant.
Release and Authorization
Participants selected to receive Prizes irrevocably agree to take part in publicity events such as press conferences, radio and television interviews and commercials, delivering written or spoken testimonials among other social engagements as and when called upon by the Agency.
By entering the Waawolo Challenge, Participants agree to the communication and publication of their names, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period at any time in any territory through any medium of release (mass media, digital media, etc.). The Agency and the Client will however not be liable for any unauthorized use, reproduction, adaptations, and publication of the images by third parties.
By taking part in the Waawolo Challenge, each Participant releases and indemnifies the Agency and the Client (including their officers, employees and subcontractors) from and against all actions, liabilities, penalties, claims or demands the Participant may have against the Agency and/or the Client or that the Agency and/or the Client may incur for any loss or damage which is or may be suffered or sustained as a direct or indirect result of participation in the Waawolo Challenge or winning or failing to win a Prize, except for any liability which cannot be excluded by law or which would cause any part of this clause to be void or unenforceable.
Variation and Disqualification
The Agency reserves the right to cancel, amend or vary the Waawolo Challenge and the rules thereof at any time with or without prior notice to the general public.
The Agency shall further reserve the right, at its sole discretion to refuse a Participant his or her Prize upon the said Participant’s involvement in any of the following incidents:
Actual or suspected fraud in relation to the Waawolo Challenge; or
Any attempt to disrupt, tamper with or unfairly influence the Waawolo Challenge, or its operation mechanism;
Breach of any of these T&C’s; and
Any other misconduct or unacceptable act as may be determined by the Agency and/or the Client.
In the event a Participant is disqualified, that Participant shall forfeit his or her Prize. In addition, the Agency and/or the Client shall reserve the right to take appropriate legal action against the said Participant.
8. Governing law & Dispute Resolution
The Waawolo Challenge and these T&C’s shall be governed by and interpreted in accordance with the laws of Ghana and where any provision of the T&C’s is adjudged by a court of competent jurisdiction as invalid, it shall not affect the remaining provisions in any way, to the extent possible.
All disputes, differences and/or claims, arising out of this Waawolo Challenge and the T&C’s, which are not resolved amicably within fourteen (14) working days of the dispute arising shall be resolved by an action in a court of competent jurisdiction in Ghana.
